DWI w/ BAC O/.17 – Not Guilty by Jury

She later failed field sobriety tests and was arrested for suspicion of Driving While Intoxicated. Client then was interviewed and admitted to being intoxicated. She gave a breath test of .147 and .153. Later at Trial in Tarrant County, Texas Courthouse the State’s expert claimed our client was likely a .17 blood alcohol content at the time of driving. After a two-day trial, our client was found Not Guilty by the Jury. The jury did not believe the breath results after the State’s witness was exposed as promoting junk science.
